Hello There,
I’m Martin, and I’d like to share my story with you. In 2021, I moved to the United States to pursue my master’s degree. After graduating, I landed a job as a Senior Data Scientist at a Fortune 500 company. It was an exciting time, but I soon faced a harsh reality: securing permanent residency in the U.S. is incredibly challenging.
With companies cutting back on sponsorships due to widespread layoffs, I found myself with limited options. Traditional employer-sponsored visas were off the table. That’s when I discovered two self-sponsorship routes that could make my American dream a reality—the National Interest Waiver (NIW) Visa and the EB1A Extraordinary Ability Visa.
Let me break these down:
- NIW Visa (EB2 National Interest Waiver): This visa allows professionals with exceptional abilities or advanced degrees to self-petition for a green card. You don’t need a job offer or employer sponsorship. Instead, you must prove that your work is in the national interest of the United States. This means showing that your contributions have substantial merit and are of significant benefit to the country.
- EB1A Visa (Extraordinary Ability): The EB1A visa is for individuals who have risen to the very top of their field. It requires demonstrating extraordinary ability in the sciences, arts, education, business, or athletics. You need to show sustained national or international acclaim with extensive documentation of your achievements.
My Journey with the NIW Visa
I couldn’t afford a lawyer, so I decided to take matters into my own hands. I spent months reading through every USCIS policy manual and guideline I could find online. In December 2023, I started drafting my own EB2 NIW petition. It was a challenging process, but I was determined.
On January 4th, I submitted my petition. Just a week later, I received an email from USCIS: my petition had been approved! I was overjoyed, thinking I was well on my way to getting my green card.
However, my excitement was short-lived. I soon learned about something called the Priority Date. This is essentially your number in a long queue for visa availability. Unfortunately, the wait time for the EB2 NIW category had become significantly longer. I realized I’d have to wait about two years before I could even file my green card application (I-485).
My Journey with EB1A Visa
I wasn’t willing to wait two years. So, I set my sights on the EB1A visa. At first, I was hesitant. The EB1A category is known for its stringent requirements and is considered one of the most challenging visas to obtain.
But then I thought, “If others can do it, why can’t I?” I saw friends and colleagues successfully secure their EB1A visas. That gave me the confidence to give it a shot. I believed that with a well-prepared petition and solid evidence, I had a real chance.
I immersed myself in research, reading over 1,000 USCIS appeal decisions related to the EB1A visa. I wanted to understand exactly how officers evaluate petitions and what pitfalls to avoid. This deep dive gave me insights that most people—and even some lawyers—might not have. This is what informed my decision summarize all the AAO Appeal decisions and and organize them here so it’s easy for others to find.

My journey taught me so much, and I realized I could help others in similar situations. I’ve already assisted a lot of people in drafting their EB1A petitions, and both were approved. Seeing their success was incredibly rewarding.

- Awards or Prizes: Have you received lesser nationally or internationally recognized prizes or awards for excellence?
- Memberships: Are you a member of associations that require outstanding achievements of their members?
- Published Material About You: Has there been published material about you in professional or major trade publications?
- Participation as a Judging: Have you served as a judge of the work of others in your field?
